CONSIDERING THAT a request to authorize the use 'Performance Bar (5823)' and to regularize the installation of three commercial signs has been submitted for the property located at 377, rue Notre-Dame;

CONSIDERING THAT the use 'Performance Bar (5823)' is part of the sub-category of uses 'Drinking establishments (c5b)' and that the use c5b is not authorized in the commercial zone Co-04-026;

CONSIDERING THAT the approval of a specific project for the construction, modification or occupation of a building (PPCMOI) and the approval of a conditional use are required for the use 'Performance Bar (5823)';

CONSIDERING THAT to minimize the negative impacts of noise perceptible from the residential neighborhood, the applicant commits to stopping music at 11:00 PM;

CONSIDERING THAT the targeted property is located in the commercial zone Co-04-026 subject to restrictive signage provisions limiting the maximum number of attached signs to two per establishment;

CONSIDERING THAT due to their non-compliance with the maximum number of attached signs and the maximum total area, the signs require the approval of a specific project for the construction, modification or occupation of a building (PPCMOI) under the Règlement relatif aux projets particuliers de construction, de modification ou d’occupation d’un immeuble numéro 507-2005;

CONSIDERING THAT the installation of the three signs on the side facade facing the street, on the main facade, and on the side facade facing the parking area ensures better visibility for the business;

CONSEQUENTLY, this Committee recommends that the council approve, under the Règlement relatif aux projets particuliers de construction, de modification ou d'occupation d'un immeuble numéro 507-2005, a commercial occupation project at 377, rue Notre-Dame, aimed at operating the following uses over the entire area of the existing business:

  • Full-service restaurant (5811 – Main use);
  • Establishment with alcoholic beverage services (5821 – Main use);
  • Performance bar (5823 – Main use);
  • Lottery and games of chance (99063 – Additional use);
  • Restaurant terrace (99139 – Accessory use).

And requiring:

  • The reduction of the distance between a building occupied by a main use belonging to the sub-category 'Drinking establishment (c5b)' and a building occupied by a main use belonging to the 'Dwelling (h)' group to less than 75m;
  • The regularization of three commercial signs.

And this conditionally upon:

  • The approval of the project by the council under the Règlement relatif aux usages conditionnels numéro 506-2005;
