Minor Exemption - 125, rue Caron

CONSIDERING THAT a request to transform and expand a single-family dwelling into a detached three-family dwelling has been made for the property located at 125, rue Caron;

CONSIDERING THAT the project requires the granting, by the council, of a minor exemption to Règlement de zonage numéro 535-2020, regarding the number of parking spaces;

CONSIDERING THAT the limited dimensions of the land and the footprint of the expanded building do not allow for the layout of a parking space that respects all the requirements of Règlement de zonage numéro 532-2020;

CONSIDERING THAT it is possible to modify the project to make it compliant with the regulations by reducing the number of units from four to two;

CONSIDERING THAT the requested minor exemption respects the enjoyment of the property rights of the owners of neighboring buildings;

CONSIDERING THAT, with the exception of the requested minor exemption, the project complies with all other provisions of the zoning and subdivision bylaws in force;

CONSIDERING THAT in accordance with the provisions of Règlement numéro 851-2023 on the methods of publication of public notices, a public notice was published on August 5, 2026, on the City of Gatineau website and that it was published at least 15 days before the meeting where the council must rule on the minor exemption request, as indicated in section 145.6 of the Loi sur l’aménagement et l’urbanisme;

CONSIDERING THAT the Comité consultatif d’urbanisme, at its meeting on August 17, 2026, did not ratify the recommendation of the Service de l’urbanisme et du développement durable and recommends that the council grant the requested minor exemption, as this committee believes that the applicant acted in good faith by filing a minor exemption request before the work was carried out:

IT IS PROPOSED BY COUNCILLOR STEVE MORAN, SECONDED BY COUNCILLOR CAROLINE MURRAY, AND RESOLVED THAT this council grants a minor exemption to Règlement de zonage numéro 532-2020, for a project at 125, rue Caron, in order to transform and expand a single-family dwelling into a three-family dwelling and aiming to reduce the minimum number of off-street parking spaces required from 4 to 2.

As illustrated in the project analysis in the plan titled:

Minor Exemption - 1-5, boulevard du Casino

CONSIDERING THAT a request for the expansion of a commercial building located at 1-5, boulevard du Casino has been made to increase the capacity of the Centre de congrès du Lac-Leamy;

CONSIDERING THAT a minor exemption to Règlement de zonage numéro 532-2020 is required to allow this expansion, which would have a height of four stories while the zoning grid Co-08-016 prescribes a minimum height of six stories;

CONSIDERING THAT the requested minor exemption respects the guidelines of the current special urban plan, which provides for a recreational-tourist vocation for the casino hub;

CONSIDERING THAT the existing building, including the casino, hotel, performance hall, and convention center, was built between 1996 and 2001, in accordance with the regulations applicable at the time;

CONSIDERING THAT nearly 93% of the footprint of the Lac-Leamy hotel-casino complex is occupied by buildings with a height of less than six stories;

CONSIDERING THAT the proposed expansion, with an approximate area of 1,805 m², would bring the proportion of the footprint occupied by buildings with a height of less than six stories to 94.3%;

CONSIDERING THAT the application of the current regulations causes serious prejudice to the applicant, since an increase in the height of the project would hinder its functionality, complicate the emergency evacuation strategy on a restricted site, and require significant modifications to the existing convention center;

CONSIDERING THAT the granting of the minor exemption does not infringe upon the enjoyment, by the owners of neighboring buildings, of their property rights;

CONSIDERING THAT the project complies with all applicable provisions of Règlement de zonage numéro 532-2020, with the exception of the one covered by this minor exemption request;

CONSIDERING THAT the granting of the minor exemption is required for the issuance of the foundation and excavation permit and the building permit for the main building;

CONSIDERING THAT in accordance with the provisions of Règlement numéro 851-2023 on the methods of publication of public notices, a public notice was published on August 5, 2026, on the City of Gatineau website and that it was published at least 15 days before the meeting where the council must rule on the minor exemption request, as indicated in section 145.6 of the Loi sur l’aménagement et l’urbanisme;

CONSIDERING THAT the Comité consultatif d’urbanisme, at its meeting on August 17, 2026, ratified the recommendation of the Service de l’urbanisme et du développement durable:

IT IS PROPOSED BY COUNCILLOR ISABELLE COUSINEAU, SECONDED BY COUNCILLOR CAROLINE MURRAY, AND RESOLVED THAT this council grants a minor exemption to Règlement de zonage numéro 532-2020, for the expansion of a commercial building housing a convention center, in order to reduce the minimum height required in the zoning grid Co-08-016 from six to four stories, as illustrated in the project analysis in the plans titled:

  • Architectural drawings – Issue for excavation and foundation permit – ACDF architecture – 2026-07-15 – Annotated by the SUDD.

CONSIDERING THAT the Comité sur les demandes de démolition approved the demolition of the existing two-unit building located on the property in question, during its meeting on August 14, 2024;

CONSIDERING THAT the project must be approved under Règlement relatif aux plans d’implantation et d’intégration architecturale numéro 535-2025, because the property is located in a sensitive environment area and must be evaluated in accordance with the provisions of chapter 6 (sensitive environment) of the bylaw;

CONSIDERING THAT the realization of this project requires the granting by the council of five minor exemptions to Règlement de zonage numéro 532-2020;

CONSIDERING THAT the project complies with all provisions of Règlement de zonage numéro 532-2020, with the exception of the requested minor exemptions;

CONSIDERING THAT in accordance with the provisions of Règlement numéro 851-2023 on the methods of publication of public notices, a public notice was published on August 5, 2026, on the City of Gatineau website and that it was published at least 15 days before the meeting where the council must rule on the minor exemption request, as indicated in section 145.6 of the Loi sur l’aménagement et l’urbanisme;

CONSIDERING THAT the limited dimensions of the land, the presence of a riparian strip and a sanitary sewer easement, combined with the area and the footprint of the proposed building, do not allow for the layout of a parking space that is fully compliant with the requirements of Règlement de zonage numéro 532-2020;
